What are LCS Ultimate Asset Protection Trusts?


Asset Protection Trusts (APTs) are an express form of Discretionary Trust


An extremely good way to protect and ring-fence assets


The APT is a separate document written independently of a Will


Unlike most Discretionary Trusts, APTs are set up during your lifetime


APTs can protect your assets for you and your family


You decide who to appoint as your Trustees (people who look after the Trust)


Any assets placed into the APT are managed and looked after by your Trustees


Assets within the APT become the property of the Trust, given by you

What can I put into my APT?

  • You decide what is right for you; this could be property, cash or investments
  • Current legislation states that each individual can place up to the Nil Rate Band (NRB) – currently £325,000 (as of 2015)
  • A couple could place both of their NRBs - £650,000 into their APT
  • Placing more than the NRB into your APT will incur immediate and on-going tax liabilities
  • LCS have associate Independent Financial Advisers (IFAs) who can advise and assist with all matters of taxation.

Do I still have control over the Trust Assets?

  • Once you have decided which Assets are to be protected they become the property of the Trust
  • Your nominated Trustees will then be responsible for the Trust Assets. This is why it is vital for you to carefully consider who to appoint into the role of Trustee
  • You may be a Trustee but you must appoint at least one other person
  • The Trustees you choose should be reliable and trustworthy.
